Can I file a lawsuit against the cruise ship in a court near my home?
A: It depends on the cruise line. In your passenger ticket, the cruise line includes what's known as a forum selection clause. This requires anyone who is bringing a claim against the cruise line to do so in a particular court. For example if you live in New York and you took a cruise that sailed to and from Miami, then even though you live in New York you would still be required to bring your claim in Florida, pursuant to most cruise passenger tickets.
